Whispering Pines HOA Annual Meeting

May 5, 2012

 

The meeting was called to order at 10:00 AM at 785 Main Ave., Durango, Colorado on May 5, 2012.

Those present were Peter Berriman, Gary Matthews, Gary Rollstin, Dan Fitzpatrick, Brian Dennis, Gary Redmond, and Adam Smith.

Those present by proxy were Deborer Crees and Paul Spencer (proxy: Gary Rollstin), Rose Stout , Wendy Jones, Sue Orr, and CDW, LLC (proxy: Dan Fitzpatrick), Mary McGee (proxy: Peter Berriman), and Bernard and Sybil Stratman (Proxy: Jon or Mary Lancaster).

The minutes were read and approved.

The treasurer’s report was reviewed.  The Association has $16775.10 in checking and $2969.86 in savings for a total of $19744.96.

The delinquencies are Lora & Lance Mattice ($260), Rian Ream ($130), Adam Smith ($130), Gina Schultz ($3874), and Christopher Davidson ($390).

The budget was approved.

Gary Rollstin was elected to the board for another 3 years until 2015.  He joins Dan Fitzpatrick (2013), Peter Berriman (2013), Wendy Jones (2014) and Marleah Ward (2014).

Old Business:

Report on the building behind:  The windows and doors and been replaced.  They have received a federal grand to hire a security man onsite 24 hours.   The problems have not increased so this is just preventative.

Artur Spirin in #10 is a noise problem.  He has stopped throwing cigarette butts out on the grounds.  He has been fined in the past and paid those fines.  A warning letter has been sent again.

Pets:  About 14 units have cats and about 4 have dogs.  There are no problems at this time.

Peter would like to know if the Association’s restrictions on the number of people in the unit exceeds what the CC&R’s allow.   No one knew.  Peter said since it isn’t a problem right now there is no need to pursue it.  He will look in to it.

Keyless locks were put in on the storage/laundry room locks.  Sometimes they don’t work.  The buttons stick. 

Landscaping Committee Report:  the grounds look great.  Money will be spent on annuals and fertilizer.  There should be enough in the budget to pay for this year’s needs.

The lawn mowing is done by the Lancasters.  The mower has been serviced for this year.  Mowing is done on demand.

The carpet needs to be replaced in the hallways.  Tabled for this year.

Because of a leak, Animas Water Company discovered where the water line is.  The single family house has been receiving water for free for years.  Now, the Association is reading the meter and billing the house for their share.  Dan Fitzpatrick feels that the water line should be dug up and capped so the Association is no longer providing water for the house.  The Association spent $6000 trying to locate the water line.  The owner wouldn’t let anyone on his land to find the line.  He may have even known where the line was.  They have never paid a water bill.  

A letter will be sent to the owners asking them to pay the $6000 line locate bill within 30 days.  They will be reminded that they haven’t paid water bills in years.  If they refuse, the water line will be capped.  Dan offered to rent a backhoe and uncover the lines and put in the necessary materials to cap it.

Legal action will be taken to collect the bill owed.

New Business:

 

Caroni compared the income from the washers and dryers for the same period of time October-April both before and after the washer/dryer service was dropped.  While employing the washer/dryer service, the gross income was $1810.27, 50% of the gross income.  After purchasing the new washers and dryers the income, after paying the Lancaster’s 20% to collect and deposit the money, was $2695.49 for the same period of time.  That is an increase of 65%.  The past split with the w/d company was 50/50.  The new split with the Lancasters is 80/20 so you would expect that the income would go up 30% at least.  It is averaging about $400/month.  A motion was made to put $50.00/month from the washer/dryer income  into savings.  Passed.

The fence in the back is leaning because it was not possible to dig down very far in the ground.  This time the posts will be set in concrete.

A car from the project behind the units rolled through a fence on the East side.  An insurance claim will be filed with our insurance company.  A letter will be sent to the owner of the building asking them to reimburse the Association for the cost of repairs.

A contract is being worked on with the Lancasters that include a job description. Once approved by all the parties, it will be for a year at a time.  If the Association wants jobs done by the Lancasters that are not in job description they will have to be paid extra.

An estimate to replace 2 bedroom windows and a slider in the older units was $800/unit.  Many of the owners have replaced their windows and are continuing to do it on their own as they afford it.  French doors are alright as long as they are without criss-crosses in it, just plain glass.

A motion was made that all owners with original windows must replace their doors and windows within 5 years, by 2017, or the Association will have them done and charge the owners for them. 

A motion was made that legal action be taken against the owners of the back building for unpaid snow removal bills.  Peter said that he would handle the legal action.  Motion passed.

Peter Berriman will also work to try to get a written agreement about road maintenance with The Pines, the apartments, and the single family home.

Peter Berriman will also pursue Gina Schultz (#39) in small claims court.   She is renting her unit out but isn’t paying dues.  

The group decided not to raise the dues but to pursue collecting money that is owed to the Association.

The meeting was adjourned at 11:35 AM.
